Online Internet Account Services Agreement


Producers Livestock Credit Corporation (“PLCC”) Online Internet Account Services are additional “electronic” services provided to increase the convenience for our customers.

A. What this Agreement Covers

This Online Internet Account Services Agreement (the “Agreement”) between you (the “User”) and PLCC is a contract which governs your electronic access to your accounts at PLCC and use of our PLCC Online Internet Account Services (“Online Account Services”), and other applicable "online services," which are electronic services that permit PLCC customers to access a number of financial services through the use of personal computers or similar devices.

To provide Online Account Services, we may contract with one or more third parties from time to time.  PLCC reserves the right to change vendors from time to time, without notice to you.  By applying for any of these services, use of any services, or continued use of these services, you consent to our use of vendors and our sharing of information about you with vendors.  You may be required to make transactions directly with or through vendors in order to use these services.  

By using any of the Online Account Services or by using any website owned by PLCC or by Producers Livestock Marketing Association (“PLMA”), you agree to abide by the terms and conditions of this Agreement, and you agree to PLMA’s online Terms and Conditions and Privacy Policy.  This Agreement should be read in conjunction with PLMA’s Terms and Conditions and Privacy Policy, which constitute a single agreement.  In the event of any conflict between this Agreement and the PLMA Terms and Conditions or the PLMA Privacy Policy, this Agreement controls.  Please read them carefully.

Nothing in this Agreement shall limit or modify, or be construed to limit or modify, any other obligations of the User, PLMA or PLCC to one another under other agreements, such as for a loan or other service or product.

B. Acceptance of the Agreement

By using any of the PLCC Online Account Services, you agree to abide by the terms and conditions of this Agreement.  Your initial use of PLCC Online Account Services constitutes your acceptance and agreement to be bound by all of the terms and conditions of this Agreement and any other PLCC Documents.  To the extent that there is any variance between the terms or conditions of this Agreement and any other applicable PLCC Documents, this Agreement shall govern with regard to the services specifically addressed herein.  Otherwise, the PLCC Documents shall govern. 

C. Relation to Other Agreements

Your use of PLCC Online Account Services to access your accounts does not change the agreement you already have with us on those accounts.  When you use PLCC Online Account Services to access an account, you do so under the terms and conditions we gave you in the agreement and disclosure for that account.

D. Definitions

The terms "we," "us", “our” and "PLCC" refer to Producers Livestock Credit Corporation.  The words "you" and "your" refer to the person(s) named as applicants on the application or enrollment form for the Online Account Services or who actually uses the Online Account Services.  The term "business day" means Monday through Friday, excluding Saturday, Sunday and holidays.  These terms are in addition to the terms and conditions included in any other agreements or disclosures you have been provided governing the account products, loans and services you may have with us, collectively referred to as “PLCC Documents.”  These “PLCC Documents” may be modified from time to time.

E. Online Account Services

The Online Account Services covered by this Agreement are those that we make available to you through the Online Account Service. The Online Account Services currently include the ability to review and download account information. We may suspend Online Account Services at our discretion. Account access may not be available for multiple signature accounts. You are responsible for the equipment you use to access the Online Account Services as well as for any software requirements.  It is also your responsibility to have a connection to the Internet through an Internet Service Provider (ISP).  We are not responsible for providing any equipment, services, or advice related to equipment necessary to interface with the online account system, and we are not responsible for any error in connections, transmissions or otherwise regarding any system, software, entries or instructions. It is your responsibility to protect your computer from all computer threats, such as viruses.  You are liable for losses stemming from the insecure storage of your written access ID and password information, password sharing and the use of insecure public computers.

F. Access

Once we have received your Online Account Services Application and verified your account information, we will send you, either by Email or by postal mail, a confirmation of our acceptance of your enrollment along with your assigned login ID and temporary password.  You will change the password upon your initial login to the Online Account Services System (the “System”).  You accept responsibility for the confidentiality and security of your password and agree to change your password every six months. 

When using PLCC Online Internet Account Services, you must, when prompted, enter the requested authentication and login credentials, including your login ID and password.  By entering the correct information, you will have direct access to view transactions on your PLCC Payment Plus account. If you believe that your online password may have been lost or stolen, or that someone has accessed your account without permission, please notify us immediately.

G. Hours of Access

You may access the Online Account Services through the System seven days a week, 24 hours a day. However, there may be times when the System is unavailable due to System maintenance or an emergency.

H. Security

Your role is extremely important in the prevention of any wrongful use of your account. You agree not to give or make available your Password or other means to access your account to any unauthorized individuals.  You are responsible for all transactions you authorize using Online Account Services. If you permit other persons to use your Online Account Service or other means to access your account, you are responsible for their conduct and / or any transactions they authorize. If you believe that your Password has been lost or stolen or that someone may attempt to use the Online Account Services without your consent or permission, you must contact us immediately.  You must promptly examine your statement upon receipt. I. Fees and Charges for Online Banking Services

PLCC Online Internet Account Services are provided as a free service to all PLCC customers with a Payment Plus Account.  Other fees, as described in the applicable PLCC Documents, may apply to other services.  You agree to pay all such fees.

You agree to be responsible for any telephone charges which you incur by accessing your accounts through PLCC Online Account Services.  You are also responsible for any fees assessed and billed separately by your online service provider.

J. Consent to Electronic Delivery Notice

You agree that any notice or other type of communication provided to you pursuant to the terms of this Agreement, and any future disclosures required by law, may be electronically provided by posting the notice on the System site or by E-Mail.  You agree to notify us immediately of any change in your email address.

K. Limit of PLCC’s and Other Providers' Liability

PLCC agrees to make reasonable efforts to ensure full performance of our Online Account Services.  We will be responsible for acting only on those instructions sent through our Online Account Services which are actually received and cannot assume responsibility for malfunctions in communication facilities not under our control that may affect the accuracy or timeliness of messages you send.  PLCC is not responsible for any losses or delays in transmission of instructions arising out of the use of any Internet Service Provider or caused by any browser software.  Any information you receive from PLCC can only be provided on a best-efforts basis for your convenience and is not guaranteed.  PLCC is not liable for any deficiencies in the accuracy, completeness, availability or timeliness of such information or for any investment or other decision made using this information.  PLCC is not responsible for any computer virus or related problems that may be attributable to the Online Account Services or to any services provided by any Internet Services Provider. PLCC, its affiliates, and any of their respective officers, directors, employees or agents, are not responsible for any direct, indirect, special, incidental or consequential damages arising in any way out of the use of the Online Account Services.

In the absence of negligence on the part of PLCC, neither PLCC nor any software supplier is responsible for any direct, indirect, special, incidental, or consequential damages arising in any way out of the use of these services. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states the liability of PLCC or software suppliers is limited to the extent permitted by law.


In addition, PLMA, PLCC and their officers, directors, agents, contractors and employees are not liable, and you agree not to hold any of the same responsible for any damages or losses of any kind, including loss of money, goodwill or reputation, profits, intangible losses, or any special, indirect, or consequential damages resulting directly or indirectly from:

  1. Your telephone, computer, or Online Account Services not working properly;
  2. You not giving us complete, accurate, or current account numbers, or other identifying information so that a merchant institution or PLCC can properly complete a transaction;
  3. You not properly following the Online Account Services instructions or providing us with wrong or inaccurate information;
  4. The content you provide (directly or indirectly) using these Websites;
  5. Your use of or your inability to use our Websites;
  6. Any delay or failure in our provision of services or delivery of products requested;
  7. Viruses or other malicious software obtained by accessing or linking to our Websites, or any glitches, bugs, errors, or inaccuracies of any kind in our Websites or delivery of our products; 
  8. Loss of data submitted to or captured by these Websites, or unintentional loss of such data to a third-party;
  9. The content, actions, or inactions of third parties; or
  10. A suspension or other action taken with respect to your account as discussed in this Agreement or in the PLMA Terms and Conditions.
L. Statements

You will continue to receive your regular account statement either monthly or quarterly, depending on the type of account. If your statement shows an incorrect or unauthorized transaction, you agree to notify us immediately. You can call us at the number in the Contact Us section of this website.

M. Confidentiality

We will disclose information to third parties about your account or the transfer you make: (1) where it is necessary for completing transfers; or (2) in order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or (3) in order to comply with government agency or court orders.

N. Email Services

E-mail to PLCC may be used only for general, non-urgent communications and may not be reviewed by PLCC personnel immediately after they are sent and / or received.  If immediate attention is required, you must contact us by telephone or in person or through some other procedure other than the Online Account Services. E-mail messages will not serve as a substitute for any requirement imposed on you to provide us with “written” notice.

We reserve the right to terminate Services if e-mail is used for threatening, abusive, obscene, libelous, defamatory or offensive material.  Offensive material includes, among other things, sexually explicit messages or other messages that can be construed to be harassment or disparagement of others based on their race, color, religion, disability, age, sex or national origin.

O. Changes in Terms I Fees

PLCC may change its Online Account Services and the terms, including fees, set forth in this Agreement at any time.  You will be notified of any such change as required by applicable law, either by mail or by an electronic message.  Your use of these services after any such change will evidence your agreement to any changes.

P. Termination

This agreement will remain in effect until you or PLCC terminates it.  You may cancel this agreement at any time by sending a written notice to Producers Livestock Credit Corporation, 4809 S. 114th Street, Omaha, NE 68137, Attention: Internet Service Department.  PLCC may cancel this Agreement and terminate your use of any services for any reason, at any time.  We will try to notify you in advance, but we are not obligated to do so.

If you do not access your accounts via the Online Account Services for any ninety (90) day period, we reserve the right to disconnect your service.

Q. No Other Use

The Online Account Services give you access to services and information from PLCC. These services, and the information provided are the property of PLCC. You may use the Online Account Services only for your personal use, and you may not reproduce, sell or distribute all or any portion of the information provided to you by the Online Account Services.

R. Severability

In the event any one or more of the provisions of this Agreement shall for any reason be held to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable.

S. Governing Law

The terms and conditions of this Agreement shall be governed by and construed in accordance with the laws of the State of Nebraska.  Any issue relating to an account or service with PLCC which you access through the Online Account Services shall be governed by the laws specified in the agreement for that account or service if there is a separate agreement for that account or service.

T. Assignment

PLCC may assign its rights and delegate its duties under this Agreement to a company affiliated with PLCC or to any other party.  You may not assign any of your rights or duties under this Agreement at any time.

U. Entire Agreement

This Agreement is the entire agreement between you and PLCC regarding your use of PLCC Online Account Services.  This Agreement supersedes any prior discussions and agreements between you and PLCC regarding the Online Account Services delivered to you in writing, verbally or obtained at any office of PLCC or the site of any Internet Service Provider.

V. Interruptions in Service

PLCC may on a regular basis perform maintenance on the PLCC’s equipment and systems that may result in interruption of the Online Account Services. PLCC will not incur any liability to you as a result of any such interruptions.
